Terms of Service

These Terms of Service ("Terms") govern your access to and use of the talkshop.by website, the Talkshop mobile application, and the Talkshop browser extension (collectively, the "Service"), operated by Talkshop ("we," "our," or "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

To use certain features of the Service, you must create an account. You are responsible for maintaining the security of your account and for all activities that occur under your account. You must provide accurate and complete information when creating your account.

You may not use another person's account without permission. You must notify us immediately of any unauthorized use of your account.

Certain features of the Service require a paid subscription. By subscribing, you agree to pay the applicable fees. Subscriptions automatically renew unless cancelled before the end of the current billing period.

All fees are non-refundable except as required by applicable law. We reserve the right to change our subscription fees upon reasonable notice. Fee changes will apply to the next billing cycle after the change.

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content solely in connection with operating and providing the Service.

You are solely responsible for your User Content. You represent that you have the right to submit any content you provide and that your content does not violate any third party's rights.

The Service allows you to save and organize product information from third-party websites. We do not endorse, guarantee, or assume responsibility for any third-party products, services, or content. Product information displayed in the Service (including prices, descriptions, and images) is sourced from third-party websites and may not be accurate, current, or complete.

The Service and its original content (excluding User Content and third-party content), features, and functionality are and will remain the exclusive property of Talkshop. The Service is protected by copyright, trademark, and other applicable laws. Our trademarks may not be used without our prior written consent.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY PRODUCT INFORMATION DISPLAYED WILL BE ACCURATE OR COMPLETE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TALKSHOP, ITS OWNERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless Talkshop and its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for any reason, including if you breach these Terms. You may terminate your account at any time through the settings page.

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
